    <title>Michigan Forms News Alert: MC12 Revised (Again!)</title>

    <description>&lt;p&gt;&lt;strong&gt;The periodic garnishment has been revised again dated 12/15 &lt;/strong&gt;and while&lt;strong&gt; the prior 9/15 revision may still be used it must be hand corrected for garnishment of State employees.&amp;nbsp; &lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;A few decades ago you had to file a periodic garnishment for every pay period&lt;/strong&gt; (or periodic income period) &lt;strong&gt;and you paid the employer (or garnishee) $6&lt;/strong&gt; to withhold some of that pay, called the disclosure fee.&amp;nbsp; &amp;nbsp;Sometime before 2004 (as far back as we could look) the law changed to allow the garnishment to remain in effect for &lt;strong&gt;91 days but&lt;/strong&gt; &lt;strong&gt;the $6 disclosure fee remained&lt;/strong&gt;. &amp;nbsp;Then in 2013 the law extended the time that the garnishment would remain in effect to &lt;strong&gt;182 days but again the $6 disclosure fee remained unchanged.&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Well a new law just &lt;strong&gt;this past September 2015 extended the time again keeping a periodic garnishment in effect without any time limit at all&lt;/strong&gt;, lasting until the judgement debt (and costs and interest) were fully paid, which in cases of large debt could be years even decades.&amp;nbsp; Well the legislature evidently thought that $6 fee was a bit measly for all the work the garnishee had to do withholding funds every pay period for years so &lt;strong&gt;they raised the fee to $35&lt;/strong&gt; and the 9/15 revision listed that $35 as the amount to submit to the garnishee.&amp;nbsp; But alas, the legislature did not bother to change another state law that limits the disclosure fee to $6 if the employer or garnishee is the State of Michigan (MCL 600.406(3)(b)).&amp;nbsp;&amp;nbsp; So the new 12/15 revisions adds a phrase to include that exception.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;You can use up your 9/15 forms doing nothing so long as the State of Michigan is not the garnishee but if they are just cross out the $35 and hand correct it to $6&lt;/strong&gt;. &amp;nbsp;We will continue to sell our remaining stock of the 9/15 form until we can get the new revision produced in all three formats we offer (continuous, carbonless, and carbon).&amp;nbsp; If you garnish State employees often you may wish to have us backorder your orders for the new revision but if not please help us use up our existing stock to save a tree and keep form costs down.&amp;nbsp;&amp;nbsp;&amp;nbsp; &amp;nbsp;&lt;/p&gt;</description>

    <description>&lt;p&gt;&lt;strong&gt;A recent change&lt;/strong&gt; to Michigan law that will go into effect September 30, 2015 &lt;strong&gt;will allow periodic garnishments to remain in effect until the judgment is satisfied&lt;/strong&gt;.&amp;nbsp; Currently periodic garnishments are effective only for a maximum of 182 days.&amp;nbsp; &lt;strong&gt;The form, MC12, Request &amp;amp; Writ for Garnishment (Periodic), will be revised accordingly and the new form will likely be required for use after September 30.&lt;/strong&gt;&amp;nbsp; The new form will not be approved for use until that time so you should order the present 4-14 revision to fully cover your needs up through that date. &lt;/p&gt;
&lt;p&gt;The new revision is tentatively to be released to us for printing in early September but the actual date is not yet known.&amp;nbsp; The State Court says it will not be posted to the State Court website until September 30.&amp;nbsp; We hope to have stock available for sale a few weeks prior to that date but &lt;strong&gt;we will begin taking backorders for the new revision September 1st if you wish to have a standing order for it&lt;/strong&gt; once it becomes available.&amp;nbsp; As yet we do not know the revision date it will carry.&lt;/p&gt;
&lt;p&gt;For more details on the changes, the law that was changed was MCL 600.4012 as amended by 2015 PA 14.&amp;nbsp;&lt;/p&gt;</description>

&lt;p style=&quot;text-indent: 0.5in;&quot;&gt;&lt;strong&gt;MC12, MC13, and MC52, &lt;/strong&gt;the three writs of garnishment&lt;strong&gt; all had the same two minor changes&lt;/strong&gt;.&amp;nbsp; The &lt;strong&gt;order of the parts was changed&lt;/strong&gt; to make the court copy the second part.&amp;nbsp; This only changed the distribution list at the top of the form, not the body or substance of the form.&amp;nbsp; The only change in the body of the form was that &lt;strong&gt;the words &amp;ldquo;Plaintiff&amp;rdquo; and &amp;ldquo;Defendant&amp;rdquo; were made possessive&lt;/strong&gt; in the name and address sections at the top so they now read &amp;ldquo;Plaintiff&amp;rsquo;s name and address&amp;hellip;&amp;rdquo; and &amp;ldquo;Defendant&amp;rsquo;s name and address&amp;hellip;&amp;rdquo;.&amp;nbsp; This change is so minor as to be insignificant and was only made to be consistent with most other court forms.&lt;/p&gt;
&lt;p style=&quot;text-indent: 0.5in;&quot;&gt;&lt;strong&gt;MC52&lt;/strong&gt; had one additional minor change.&amp;nbsp; The gray bar at the top was extended to the left margin to include the words &quot;This portion to be completed by the court only&quot; to indicate that only referred to the check boxes in the gray bar.&amp;nbsp; &lt;/p&gt;
&lt;p style=&quot;text-indent: 0.5in;&quot;&gt;&lt;strong&gt;Because these changes do nothing to affect the actual function of the form or the way it is filled in you can use your existing stock&lt;/strong&gt; and we will try to sell the rest of our existing stock and ask you to help use that up to save trees and keep costs down.&amp;nbsp; The continuous version of MC12 and &amp;nbsp;MC52 we already are stocking in the new 4/14 version.&amp;nbsp;&lt;/p&gt;
&lt;p style=&quot;text-indent: 0.5in;&quot;&gt;Before we printed the &lt;strong&gt;MC52&lt;/strong&gt; continuous, we noticed the words &quot;State Treasurer&quot; in the distribution list at the top of the form had been changed to &quot;Garnishee&quot; (the same as on the MC12 and MC13).&amp;nbsp; We asked&amp;nbsp;the State Court if that was intentional and they said it was not and was supposed to still read &quot;State Treasurer&quot;.&amp;nbsp; We made that correction on the 4/14 version&amp;nbsp;prior to printing it.&amp;nbsp;&amp;nbsp;The State&amp;nbsp;Court however made that correction but also changed the revision date to 6/14.&amp;nbsp; They allowed the 4/14 version to be used until depleted.&amp;nbsp; Our initial press&amp;nbsp;run of the MC52&amp;nbsp;is dated 4/14 but has the correction.&amp;nbsp; Our next press run will have the revision date changed to 6/14 as well.&amp;nbsp; &amp;nbsp;&lt;/p&gt;
&lt;p style=&quot;text-indent: 0.5in;&quot;&gt;&lt;strong&gt;MC09 , Dismissal&lt;/strong&gt;, had a check box at the bottom added for the phrase, &amp;ldquo;this order resolves the &lt;strong&gt;last pending claim and closes the case&lt;/strong&gt;&amp;rdquo;.&lt;/p&gt;
&lt;p style=&quot;text-indent: 0.5in;&quot;&gt;&lt;strong&gt;MC09a, Dismissal, Nonservice/No Progress&lt;/strong&gt;, had a citation corrected at the bottom.&amp;nbsp; On both dismissal forms the words Plaintiff and Defendant were also changed to the possessive as was done to the garnishment forms.&amp;nbsp; We already have the new MC09 in stock in snap sets and will have it shortly in continuous format.&lt;/p&gt;

&lt;p&gt;&lt;span style=&quot;font-family: &#39;Times New Roman&#39;; font-size: 16px;&quot;&gt;Please note that initially the Michigan State Court form index said the 4/12 revision&amp;nbsp;could still be used&lt;em&gt; with hand correction&lt;/em&gt; and some local courts began to insist on the correction.&amp;nbsp; &lt;strong&gt;We contacted the State Court and asked if that hand correction was really necessary.&amp;nbsp; They agreed it was not&lt;/strong&gt; and as of 1-20-2014 the index was changed deleting the hand correction requirement.&amp;nbsp; Instead they added a cutoff date of next December (2014)&amp;nbsp;for using the existing stock.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span style=&quot;font-family: &#39;Times New Roman&#39;; font-size: 16px;&quot;&gt;&lt;strong&gt;The only significant change to the form was changing the time for service from 91 days to 182 days&lt;/strong&gt;.&amp;nbsp; &lt;strong&gt;This has virtually no impact on typical usage&lt;/strong&gt; at all and is merely perfunctory to make the form comply with the last year&amp;rsquo;s modification to the law that extended the duration for service for all types of garnishments.&amp;nbsp; MC12 was modified at the time (revised 6/13).&amp;nbsp; The MC52 form was not affected&amp;nbsp;as it does not mention the time duration for service&amp;nbsp;(but in use the longer time for service could be helpful with tax garnishments).&amp;nbsp; In contrast we don&amp;rsquo;t think the change to the MC13 will affect usage&amp;nbsp;since&lt;strong&gt; it would be unusual not to serve a one-time non-periodic garnishment&amp;nbsp;as soon as possible.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style=&quot;margin: 0px; text-indent: 36px; font-size: 12px;&quot;&gt;&lt;span style=&quot;letter-spacing: 0px; font-family: arial;&quot;&gt;&lt;strong&gt;The MC12 was revised again and dated 6/13 &lt;/strong&gt;to comply with a new change to court rules that will allow 182 days for service on the garnishee.&amp;nbsp; &lt;strong&gt;The new rule will extend that time for service for all garnishments &amp;ndash; periodic (MC12), nonperiodic (MC13) and tax (MC52)&lt;/strong&gt;.&amp;nbsp; Since that time for service is not mentioned on the MC52 it did not need revision.&amp;nbsp; The MC13 was also just revised in similar fashion to the MC12&amp;nbsp;and now with a revision date of&amp;nbsp;1/14 .&amp;nbsp;&amp;nbsp;For both the MC12 and MC13&amp;nbsp;you will be able to use up the previous revision (dated 10/12 for MC12 and 4/12 for MC13)&amp;nbsp;with a simple hand correction until stock is depleted (see our note below**). &amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p style=&quot;margin: 0px; text-indent: 36px; font-size: 12px;&quot;&gt;&lt;span style=&quot;letter-spacing: 0px; font-family: arial;&quot;&gt;&lt;strong&gt;Here are more details&lt;/strong&gt;.&amp;nbsp; Last year in October the MC12 was revised to accommodate a new change to the law, MCL600.4012(1), that allowed the duration of a wage garnishment to last up to 182 days, up from the previous 91 days.&amp;nbsp; Note that law only applied to wages (salary or earnings).&amp;nbsp; At that time Michigan Court Rules were also changed that allowed the duration of a periodic garnishment to be 182 days for any kind of periodic garnishment, not just wages. This was done in MCR3.101(B)(1)(a)(ii).&amp;nbsp; In that same rule, section (E)(2) the date of service was extended to 182 days after issue for any writ of garnishment (including tax and non-periodic garnishments) but unfortunately in section (F)(1) there was also a reference to the time for service that was left at 91 days.&amp;nbsp; Due to the conflict between the rules in sections (E) and (F), essentially the shorter 91 days for service remained if effect for any type of garnishment.&amp;nbsp; Because of that the 10/12 revision of MC12 kept the reference to the time for service at 91 days in the note &amp;ldquo;TO THE PLAINTIFF&amp;rdquo; about mid way down the form. &amp;nbsp; At the bottom of the form in item 5, where it previously had said the duration of the periodic garnishment was 91 days, it was changed to read simply &amp;ldquo;the expiration date&amp;rdquo;. &amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p style=&quot;margin: 0px; font-size: 12px;&quot;&gt;&lt;span style=&quot;letter-spacing: 0px; font-family: arial;&quot;&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;Well this reference to 91 days for service in the middle of the form (with no reference to 182 days anywhere on the form) caused much confusion with court clerks and plaintiffs thinking that the 10/12 revision was still limited to 91 days.&amp;nbsp; Only the time to serve the writ on the garnishee was still limited to 91 days and that only because of a conflict in the two sections of the court rules.&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;span style=&quot;letter-spacing: 0px; font-family: arial;&quot;&gt;However this was destined to be temporary because in theory as long as your garnishment is still effective (182 days) you should still be able to serve it.&amp;nbsp; So the court eventually changed section (F)(1) from 91 days to 182 days so that it is consistent with section (E)(2) of&amp;nbsp; MCR3.101.&amp;nbsp; That change resulted in the new 6/13 revision of MC12.&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
